New Jersey is one of those few states where the products liability claim is not a negligence claim. It is a strict liability claim. That is, the manufacturer of the product is responsible, where that product is defective, not fit suitable or safe for its intended purpose.

If you can establish that the product was defective, you’re entitled to prevail. You do not need to prove negligence, and that is a key element of the products liability claim in New Jersey.
