If your child unfortunately suffers injury as a result of the negligence of another party, you bring the suit on behalf of your child, as a guardian ad litem. When your child is eighteen years old, then they can bring the claim in their own right. But until your child is eighteen, you have to bring the claim on their behalf. Now statute of limitations is different for children. You as an adult have two years from the accident to file a lawsuit. The child has until his or her twentieth birthday. But, it doesn’t mean you wait with a young child til their twenty. The memories of witnesses fade, proofs are harder to come by.
