Strict Liability for Dog Bites

FAQ Video Transcription

In most circumstances in New Jersey, if you’ve been injured by a neighbor’s dog, you’ve every right to recover. If your not a trespasser, if you’re out walking about and the neighbor’s dog breaks away and bites you, you have the right to recover under New Jersey law, what we call strict liability, the neighbor is responsible, and in those circumstances if the neighbor has a home, their home owner’s policy will cover that risk. So yes, now depending on the circumstances, if your knocked over by the neighbor’s dog, you may well have a right to recover, but if your bitten, you have an absolute right to recover.
