We have what’s called a statute of limitations. After an accident has occurred, you must bring a lawsuit in New Jersey, either in the state or federal court in New Jersey depending on the facts within two years of the accident. In New York you have three years to bring a lawsuit for personal injury.

I would add though in New Jersey, if you’ve been injured as the result of the negligence of a governmental entity, such as a county or the state, or a township or any other public entity such as a state hospital, such as Robert Wood Johnson or University Hospital in Newark, you must file what’s called a notice of claim, within ninety days of the accident, or your claim will be barred.
